The Social Economy Sector is essential to respond, in cooperation with the State, to the needs of citizens. Within the Social Economy Sector coexist the Mutualist Associations, which have a meritorious past, protecting the portuguese in the area of social security and health for more than 800 years. In this sense, public policies, whether from a more structural or cyclical point of view, play a fundamental role in the dynamics and affirmation of the Social Economy, namely Mutualist Associations. Thus, this study intends to make a small contribution, from the perspective of political and legislative orientation, to the revival of the Mutualist Movement. To this end, a characterisation of the mutualist movement in Portugal is made and a critical analysis of the legal regime of mutualist associations, namely the Mutualist Associations Code, in the scope of freedom of association, interference in tutelage and supervision of the constitution process and the electoral process of associative bodies, as well as launching challenges for the creation of financing instruments for the benefit modalities, free access to the exercise of economic activities, through the reformulation of a legal regime that allows us to respond to the challenges and opportunities of this new era, leading to the growth and development of the entire mutualist movement at the service of communities and citizens, which is the intention.
