Rumo a uma política comum de asilo mais humana, equitativa e eficaz

The unprecedented arrival of migrants and asylum-seekers in Europe, in mid-2015, revealed severe problems in the design and application of the Common European Asylum System, highlighting its need for reform. In response to the migratory challenge, the European Union embarked on a comprehensive process of reform aimed at restructuring its asylum and migration policies, pointing as a priority to the reform of the Dublin III Regulation, the application of which results in a uneven distribution of asylum-seekers amongst Member States and seriously compromises the fundamental rights and guarantees of those seeking refuge. Against this background, the Commission presented, in May 2016, a legislative proposal aimed at recasting the Dublin rules in the light of the principle of solidarity and fair sharing of responsibilities, seeking to improve the efficiency of the system and render it more capable of providing an adequate response to the needs of those who turn to it. Commonly known as “Dublin IV”, this is the draft regulation that we seek to analyze in the current dissertation. More specifically, we intend to study the proposed changes in the light of two essential goals: that of ensuring a fair sharing of responsibilities between Member States and that of safeguarding the fundamental rights and guarantees of asylum-seekers. On this topic, we make recommendations to improve the proposal under analysis and, ultimately, suggest the implementation of measures in other areas in order to render the common asylum policy more humane, equitable and effective.
