Resumo: | The unprecedented arrival of migrants and asylum-seekers in Europe, in mid-2015, revealed severe problems in the design and application of the Common European Asylum System, highlighting its need for reform. In response to the migratory challenge, the European Union embarked on a comprehensive process of reform aimed at restructuring its asylum and migration policies, pointing as a priority to the reform of the Dublin III Regulation, the application of which results in a uneven distribution of asylum-seekers amongst Member States and seriously compromises the fundamental rights and guarantees of those seeking refuge. Against this background, the Commission presented, in May 2016, a legislative proposal aimed at recasting the Dublin rules in the light of the principle of solidarity and fair sharing of responsibilities, seeking to improve the efficiency of the system and render it more capable of providing an adequate response to the needs of those who turn to it. Commonly known as “Dublin IV”, this is the draft regulation that we seek to analyze in the current dissertation. More specifically, we intend to study the proposed changes in the light of two essential goals: that of ensuring a fair sharing of responsibilities between Member States and that of safeguarding the fundamental rights and guarantees of asylum-seekers. On this topic, we make recommendations to improve the proposal under analysis and, ultimately, suggest the implementation of measures in other areas in order to render the common asylum policy more humane, equitable and effective. |

Em resposta ao desafio migratório, a União Europeia embarcou num processo amplo de reforma destinado a restruturar as suas políticas de asilo e imigração, tomando como prioritária a reforma do Regulamento de Dublin III, cuja aplicação resulta numa distribuição desproporcionada de requerentes de asilo entre os Estados-Membros e compromete, de forma grave, os direitos e as garantias fundamentais daqueles que buscam refúgio. Neste contexto, a Comissão apresentou, em maio de 2016, uma proposta legislativa no intuito de reformular as normas de Dublin à luz do princípio da solidariedade e da partilha equitativa de responsabilidades, procurando, ao mesmo tempo, tornar o sistema mais eficiente e capaz de dar uma resposta adequada às necessidades daqueles que a ele recorrem. Vulgarmente conhecida como “Dublin IV”, é esta proposta de regulamento que nos propomos a analisar na presente dissertação. Pretendemos, mais concretamente, estudar as mudanças visadas à luz de dois objetivos essenciais: o de garantir uma partilha justa de responsabilidades entre Estados-Membros e o de salvaguardar os direitos e as garantias fundamentais dos requerentes de asilo.
