Reflections on the law after the genocide: forty years since the “night of the ties”

Resumo: The work is developed from a punctual fact, but of great symbolic power, succeeded during the last Argentine military dictatorship (1976-1983), regarding the role of Law and lawyers, based on distinctions such as state of law and state of exception, following the category proposed by Agamben. This article emphasizes that reverting the formula of Clausewitz (war is the continuation of politics by other means), shifts the legal / illegal logic in Law, and replaces it with the logic of war, friend / foe, in which what disappears is the very concept of citizenship, leaving bodies, nuda vita, subjected to “guardians”, with the purpose of disciplining society. The episode known as the “night of the ties”, when many labor lawyers were kidnapped, tortured, some of them dead and others disappeared, shows how the conscious work of defensive lawyers implies, for the logic of the state of exception, an intolerable irritation that must be quickly eliminated. The study concludes by reflecting on the role of memory, advocacy, Law, and, based on the essay by Ricoeur, on the possibility of preventing facts like Auschwitz, or something analogous to the state of exception, from returning.

Señala que la inversión de la fórmula de Clausewitz (la guerra es la continuación de la política por otros medios), desplaza la lógica jurídica legal/ilegal, para reemplazarla por la lógica de la guerra, de amigo/enemigo, donde lo que desaparece es el propio concepto de ciudadano, dejando los cuerpos, la nuda vita, a disposición de los guardianes, con el propósito de disciplinar a la sociedad. El episodio conocido como la noche de las corbatas, donde un grupo de abogados laboralistas es secuestrado, torturado, algunos de ellos muertos y los otros desaparecidos, evidencia como el ejercicio consciente de la abogacía, implica para la lógica del estado de excepción una irritación intolerable que es preciso eliminar. Concluye reflexionando sobre el rol de la memoria, el de la abogacía, y, a partir del ensayo de Ricoeur, sobre la posibilidad de impedir que Auschwitz, o su análogo, el estado de excepción, puedan retornar.O trabalho se desenvolve a partir de um fato pontual, mas de grande poder simbólico, sucedido durante a última ditadura militar argentina (1976-1983), sobre o papel do direito e dos advogados, com base em distinções tais como estado de direito e estado de exceção, seguindo a categoria proposta por Agamben. Destaca que a inversão da fórmula de Clausewitz (a guerra é a continuação da política por outros meios), desloca a lógica jurídica legal/ilegal, para substituí-la pela lógica da guerra, de amigo/inimigo, na qual o que desaparece é o próprio conceito de cidadão, deixando os corpos, a nuda vita, à disposição dos “guardiães”, com o propósito de disciplinar a sociedade. O episódio conhecido como a “noite das gravatas”, quando um grupo de advogados trabalhistas é sequestrado, torturado, alguns deles mortos e os outros desaparecidos, evidencia como o exercício consciente da advocacia implica, para a lógica do estado de exceção, uma intolerável irritação que é preciso eliminar.
