"Blowin' in the wind" - counterculture in Bob Dylan and apathy in civil procedure

Resumo: Although the study of civil procedure is usually marked by dogmatism and orthodoxy, the approach between the discipline and its concrete needs involves a greater openness to everyday life and social aspects. In this sense, dialogue with literature and culture proves to be fruitful. This essay adopts such an approach, seeking, through deductive research and bibliographic and exploratory survey, to demonstrate how the criticisms posed by Bob Dylan in the context of American counterculture (notably regarding his opposition to injustice and apathy) can provide relevant insights into procedural law. The aim is to shed light on the technicist and exclusionary dynamics that characterize the process, particularly in its opposition to injustice and apathy within its dominant culture, breaking the image of the discipline's naturalness and problematizing its foundations to bring them closer to real access to justice.

En este sentido, el diálogo con la literatura y la cultura resulta ser fructífero. Este ensayo adopta dicho enfoque, buscando, a través de la investigación deductiva y del levantamiento bibliográfico y exploratorio, demostrar cómo las críticas planteadas por Bob Dylan en el contexto de la contracultura estadounidense (especialmente en lo que respecta a su oposición a la injusticia y la apatía) pueden brindar ideas relevantes sobre el derecho procesal. El objetivo es arrojar luz sobre las dinámicas tecnicistas y excluyentes que caracterizan el proceso, especialmente en su oposición a la injusticia y la apatía dentro de su cultura dominante, rompiendo la imagen de naturalidad de la disciplina y problematizando sus fundamentos para acercarlos a un acceso real a la justicia.Embora o estudo do processo civil usualmente seja marcado pelo dogmatismo e pela ortodoxia, a aproximação entre a matéria e as suas necessidades concretas passa por uma maior abertura ao cotidiano e ao social. Nesse sentido, o diálogo com a literatura e a cultura mostra-se prolífico. O presente ensaio adota essa abordagem, procurando, por meio de pesquisa dedutiva e de levantamento bibliográfico e exploratório, demonstrar como as críticas postas por Bob Dylan no contexto da contracultura estadunidense (notadamente no que toca à sua oposição à injustiça e à apatia) podem trazer insights pertinentes ao direito processual. Almeja-se, assim, colocar luzes sobre a dinâmica tecnicista e excludente que marcam o processo e a notadamente no que toca à sua oposição à injustiça e à apatia sua cultura dominante, rompendo a imagem de naturalidade da disciplina e problematizando suas bases para aproximá-las de um real acesso à justiça.
