“Essay on blindness”: the feeling of denial and the cataclysm of the pandemic

Resumo: The purpose of the article is, based on the facts portrayed in Ensaio sobre a cegueira, by José Saramago, to reflect on human behavior in the face of measures to face the public health emergency resulting from the coronavirus outbreak, at the end of 2019. Saramago's description of the (re)discoveries of the human essence, while they are protected in quarantine, pursued by fear, insecurity and doubts in the face of a new, invisible and unknown "enemy", the article proposes to critically analyze the pandemic moment in the Brazil. Through the provisions of Law 13,979, of February 6, 2020, used as a theoretical framework, the research outlines an overview of the public policies adopted in the country to contain Covid-19. In the second section, the article seeks to make an analogy with the behavior of the characters in the book by the Portuguese poet and Brazilians, mentioning legal, ethical, love, solidarity, political, economic and social issues, highlighting the aspects of the relationship between State, law and society. With jusliterary studies, the bibliographic research is based on a critical-reflective approach on the subject, using literature to embody the law.

La descripción de Saramago de los (re)descubrimientos de la esencia humana, mientras se protegen en la cuarentena, perseguidos por el miedo, la inseguridad y las dudas frente a un nuevo “enemigo”, invisible y desconocido, el artículo propone analizar críticamente el momento de la pandemia en el Brasil. A través de lo dispuesto en la Ley 13.979, de 6 de febrero de 2020, utilizado como marco teórico, la investigación esboza un panorama de las políticas públicas adoptadas en el país para la contención del Covid-19. En la segunda sección, el artículo busca hacer una analogía con el comportamiento de los personajes del libro del poeta portugués y los brasileños, mencionando cuestiones jurídicas, éticas, amorosas, solidarias, políticas, económicas y sociales, destacando los aspectos de la relación entre Estado, derecho y sociedad. Con los estudios jusliterarios, la investigación bibliográfica se fundamenta en un abordaje crítico-reflexivo sobre el tema, utilizando la literatura para encarnar el derecho.A proposta do artigo é, a partir dos fatos retratados em Ensaio sobre a cegueira, de José Saramago, refletir sobre o comportamento humano diante das medidas para enfrentamento da emergência de saúde pública decorrente do surto de coronavírus, no final de 2019. Lastreada na singular descrição de Saramago sobre os (re)descobrimentos da essência humana, enquanto estão resguardados em quarentena, perseguidos pelo medo, pela insegurança e pelas dúvidas diante de um novo “inimigo” invisível e desconhecido, o artigo se propõe a analisar criticamente o momento pandêmico no Brasil. Por meio dos dispositivos da Lei 13.979, de 06 de fevereiro de 2020, utilizada como marco teórico, a pesquisa traça um panorama das políticas públicas adotadas no país para conter a Covid-19. Na segunda seção, o artigo busca fazer uma analogia com os comportamentos das personagens do livro do poeta português e os brasileiros, mencionando questões legais, de ética, amor, solidariedade, política, economia e sociais, evidenciando os aspectos da relação entre Estado, direito e sociedade.
