The right to in vitro fertilization in Brazil: a juridical-literary analysis in the light of “Brave new world”

Resumo: This paper consists of a juridical-literary analysis of the current conditions in the Brazilian context for the exercise of reproductive rights and, in particular, the right to in vitro fertilization (IVF). This practice is studied based on the decision of  the Inter-American Court in the emblematic case of Artavia Murillo and others versus Costa Rica, in order to show the inseparability of theory and practice, especially with regard to the area of rights and guarantees at the domestic and international levels of protection., In light of the novel Brave New World, this article analyzes the content of the last resolution by the CFM – Federal Medical Council of Brazil, and the rules that make up the protective system in general, which directly affect reproductive autonomy in Brazil. The analysis is made through theoretical research, eminently bibliographical and exploratory.
