Pathur Nataraja: a deity’s legal personification

Resumo: | Pathur Nataraja is a medieval Indian bronze statuette that was smuggled out of its country of origin. Seized abroad, the work of art was contested in British courts in a judgment that identified the legal personality of the Hindu deity Shiva in the lingam that had been preserved in the looted temple. Its recognition, combined with the idea of the legal personification of countless other non-human entities, such as nature, a national park, a river with its metaphysical elements, trees, non-human animals, artificial intelligence and robots, has created cracks in the traditional understanding of what it means to be a subject of rights. This fluid understanding of legal personification, present in several current legal frameworks and already perceived by a secular doctrine, is indicative of epistemic choices capable of being equally absorbed in our juridical universe. |

Apreendida no exterior, a obra de arte foi disputada na justiça britânica em julgamento que identificou a personalidade jurídica da divindade hindu Shiva no lingam que havia sido preservado no templo saqueado. Seu reconhecimento, aliado à ideia da personificação jurídica de inúmeras outras entidades não humanas, como a natureza, um parque nacional, um rio com seus elementos metafísicos, as árvores, os animais não humanos, a inteligência artificial e robôs, vem criando fissuras na tradicional compreensão sobre o que significa ser sujeito de direitos.
