Education as a personality right: in search for a constructional reformulation of legal education in the face of new technologies

Resumo: The right to education is fundamental for human development, as well as for the realization of personality rights. In this sense, the article proposes to analyze the legal education in Brazil, given its importance in the social conjecture for the Democratic State. As in regular education, legal education lacks investment in technology to train jurists who have contact with technology and practice, so much so that the National Curricular Directive (DCN) of Resolution 5/2018 was triggered, forcing simulated practice in Law courses. In this way, the work will also analyze some of the platforms currently available, pointing out their benefits and challenges. The method used was the literature review, through the analysis of doctrine, legislation and legal software available on the market, whose objective remained to point out that in practical relevance, the student’s contact with simulators is essential since this is the reality of the courts.

El derecho a la educación es fundamental al desarrollo humano, así como a la efectividad de los derechos de la personalidad. En este sentido, en el artículo se propone a analizar la enseñanza jurídica en Brasil, delante su importancia en la conjetura social para el Estado democrático. Tal como en la enseñanza regular, la enseñanza jurídica necesita de inversión en tecnología para formar juristas que posean contacto con la tecnología y con la práctica, tanto que se desencadenó la Directriz Curricular Nacional (DCN) da resolución 5/2018, obligando la práctica simulada en los cursos de derecho. De ese modo, el estudio analizará también algunas de las plataformas disponibles actualmente, apuntando sus beneficios y desafíos. El método utilizado fue la revisión de literatura, por intermedio del análisis de doctrina, legislaciones y softwares jurídicos disponibles en el mercado, cuyo objetivo restó en apuntar que, en la relevancia práctica, es esencial el contacto del alumno con simuladores ya que esa es la realidad de los tribunales. O direito à educação é fundamental para o desenvolvimento humano, bem como para a efetivação dos direitos da personalidade. Neste sentido, o artigo se propõe a analisar o ensino jurídico no Brasil, ante sua importância na conjectura social para o Estado democrático. Tal como no ensino regular, o ensino jurídico carece de investimento em tecnologia para formar juristas que possuam contato com a tecnologia e com a prática, tanto que se desencadeou a Diretriz Curricular Nacional (DCN) da resolução 5/2018, obrigando a prática simulada nos cursos de direito. Desse modo, o trabalho analisará também algumas das plataformas disponíveis atualmente, apontando seus benefícios e desafios. O método utilizado foi a revisão de literatura, por meio da análise de doutrina, legislações e softwares jurídicos disponíveis no mercado, cujo objetivo restou em apontar que na relevância prática, é essencial o contato do aluno com simuladores já que essa é a realidade dos tribunais.
