The chain of custody in criminal matters: legal and sociological conditions

Resumo: | This article corresponds to a preliminary investigation on the chain of custody and evidence in criminal proceedings. The objective was to analyze the legal and sociological conditions that underpin the regulations that regulate the chain of custody and its operation. The development consisted in the revision of the concept of chain of custody, characteristics and importance. The chain of custody is the set of steps taken when a criminal investigation begins, to ensure that the evidence collected is not changed or destroyed so that the analysis carried out by forensics of the evidence is the same as that collected at the crime scene without any change. If the guarantee of due process is violated, such as the presumption of innocence, the doubt in favor of the defendant, and objectivity, decisions would be made that punish an innocent person or that the guilty plead innocent. This work is a topic of study of transcendental importance in Criminal Law with scientific arguments that led to proposals to the questions that were observed when analyzing the process of investigation and evidence of criminal acts. The discussion of the topic expanded on these arguments about the chain of custody, the sequence of which begins from the moment in which the vestiges, samples or evidence of a criminal act is fixed, lifted, analyzed and preserved and culminates with the appraisal of its verification at the time of the oral trial, which guarantees the authenticity and legitimacy of each of the evidentiary elements in the criminal process. The investigation methodology and the conclusions of this complex process of the chain of custody were added, but due to lack of specialized personnel and limitations of the judicial system, injustices are committed, "legally invisible facts" occurring that comply with the law, but in practice it is disrespected, which tends to benefit the offender and punish the innocent. |

El objetivo fue analizar las condiciones jurídicas y sociológicas que fundamentan la normativa que regula la cadena de custodia y su funcionamiento. El desarrollo consistió en la revisión del concepto de cadena de custodia, características e importancia. La cadena de custodia es el conjunto de pasos cumplidos cuando se inicia una investigación criminalística, para velar porque las evidencias recogidas no sean cambiadas ni destruidas, para que el análisis que realicen los forenses de las evidencias sean las mismas que se recopilaron en la escena del crimen sin ningún cambio. Si se viola la garantía del debido proceso, como la presunción de inocencia, la duda a favor del reo y la objetividad, se tomarían decisiones que castiguen a un inocente o que el culpable se declare inocente. Este trabajo es un tema de estudio de trascendental importancia en el Derecho Penal, con argumentos científicos que derivaron en propuestas a los cuestionamientos que se observaron al analizar el proceso de investigación y prueba de los hechos delictivos. La discusión del tema amplió estos argumentos sobre la cadena de custodia, cuya secuencia se inicia desde el momento en que se fija, levanta, analiza y conserva los vestigios, muestras o evidencias de un hecho delictivo y culmina con la apreciación de su comprobación al momento del juicio oral, con lo cual se avala la autenticidad y legitimidad de cada uno de los elementos probatorios en el proceso penal. Se agregaron la metodología de investigación y las conclusiones de este complejo proceso de la cadena de custodia, pero que por falta de personal especializado y limitaciones del sistema judicial se cometen injusticias, ocurriendo “hechos jurídicamente invisibles” que cumplen con la ley, pero en la práctica se la irrespeta lo que tiende a beneficiar al delincuente y castigar al inocente.Este artigo corresponde a uma investigação preliminar sobre a cadeia de custódia e as provas no processo penal. O objetivo foi analisar as condições legais e sociológicas que sustentam as normas que regulam a cadeia de custódia e seu funcionamento. O desenvolvimento consistiu na revisão do conceito, características e importância da cadeia de custódia. A cadeia de custódia é o conjunto de etapas realizadas quando uma investigação criminal é iniciada, para garantir que as provas coletadas não sejam alteradas ou destruídas para que a análise realizada pela prova pericial seja a mesma que a coletada no local do crime. sem qualquer alteração. Se violada a garantia do devido processo legal, como a presunção de inocência, a dúvida em favor do acusado e a objetividade, seriam tomadas decisões que punissem um inocente ou que o culpado se declarasse inocente. Este trabalho é um tema de estudo de importância transcendental no Direito Penal com argumentos científicos que levaram a propostas para as questões que foram observadas ao analisar o processo de investigação e prova de atos criminosos. A discussão do tema ampliou esses argumentos sobre a cadeia de custódia cuja sequência começa a partir do momento em que os vestígios, amostras ou provas de um ato criminoso são fixados, coletados, analisados e preservados e culmina com a avaliação de sua verificação no momento do crime, julgamento oral, que garante a autenticidade e legitimidade de cada uma das provas no processo penal.
