Resumo: Estuda o tema da estatalidade do Direito moderno. Visa abordar os aspectos epistemológicos e históricos que fizeram com que o Estado se tornasse a única instituição detentora da competência plena para dizer o Direito. Descreve e critica a teoria do positivismo jurídico.
