Discorre sobre a classificação dos agentes públicos, para assim identificar a categoria de agentes políticos e suas subespécies. A Lei regulamenta o § 4o do artigo 37 da Constituição Federal de 1988, dispositivo que põe a salvo a aplicação das sanções penais aos atos de improbidade administrativa assim enquadrados, fazendo distinção acerca da natureza jurídica da Lei de Improbidade. Analisa a natureza jurídica das principais esferas de responsabilidade do agente político, desmistificando a não aplicabilidade da referida Lei a tais agentes em razão das prerrogativas constitucionais que são conferidas em função do cargo público. Identifica os diversos meios de tutela da probidade administrativa e demonstra que a incidência nos vários instrumentos não obsta a aplicação simultânea das normas. Consigna o juízo de 1ª instância como o foro competente para apreciar as causas de improbidade administrativa por atos praticados por agentes políticos.This work deals with the Law no 8.429/92, June 2, 1992, the essential instrument of repression brought corrupt conduct at the heart of Public Administration, for deriving actions of agents politicians. It discourses on the classification of the public agents, thus to identify to the category of agents politicians and its subspecies. The law regulates the paragraph 4o of article 37 of the Federal Constitution of 1988, which puts the device unless the application of criminal sanctions for acts of administrative improbity well framed, making distinction on the legal nature of the Law of Improbity. It analyzes the legal nature of the main spheres of responsibility of the agent politician, demystifying not the applicability of the related Law to such agents, in reason of the prerogatives constitutional that are conferred in function of the public office. It identifies the diverse ways of guardianship of the administrative probity and demonstrates that the incidence in the some instruments does not hinder the simultaneous application of the norms.
