É conceituado como um fenômeno que atinge diretamente a personalidade e a dignidade da vítima através de condutas hostis e humilhantes com o objetivo de desestabilizá-la e reduzir sua auto-estima. Caracteriza-se pela violência psicológica sofrida pelo trabalhador de forma reiterada e repetitiva. Manifesta-se através de pressões psicológicas, perseguições e humilhações. Assume várias formas, vertical (do superior para o subordinado), horizontal (entre colegas) e ascendente (do subordinado para o superior hierárquico). Foram analisados os sujeitos do assédio moral, principais características e os danos causados. Foram ainda abordadas as formas de prevenção que devem partir do empregador, sindicato e a do Ministério Público do Trabalho. Apresenta os Projetos de Lei em tramitação no Congresso Nacional, bem como as legislações existentes no âmbito estadual e municipal e analisa as decisões judiciais que formam a base jurisprudencial. Por fim, restaram analisadas as conseqüências do assédio moral à luz do princípio da dignidade da pessoa humana.A study developed concerning the moral harassment in the work environment as a confrontation to the worker’s dignity. It’s rated as the phenomenon that hits directly the personality and dignity of the victim through hostile and humiliating conduct in order to destabilize and reduce his/her selfesteem. It is characterized by the psychological violence suffered by the worker in a repeated and repetitive way. It is manifested through psychological pressure, harassment and humiliation. It takes many forms, vertical (from the superior to the subject), horizontal (among coworkers) and ascending (from the subordinate to the superior). The subjects of the moral harassment were analyzed, main characteristics and the damage caused. The ways of prevention that must come from the employer, union and Ministry of Public Work were discussed. Presents the draft laws proceeding in the National Congress, such as the existent laws in the state and municipal scope and analyzes the judicial decisions that form the legal basis.
