É verdade que ao criar as medidas sócio-educativas, o legislador buscou oferecer um diferencial no tratamento a menores, apontando neles indivíduos em fase de desenvolvimento. Dessa forma, a aplicação de penalidades deveria objetivar a recuperação deste jovem à comunidade, reintegrando-o ao convívio social, o que infelizmente não vem ocorrendo, pois as penalidades, ao serem executadas, transformam-se em penas inócuas, ineficazes, gerando a impunidade, tão reclamada e combatida por todos. A questão, portanto, não é se a maioridade penal deve ser reduzida para menos de 18 anos de idade, mas trazer à discussão a forma como medidas são aplicadas aos menores, em busca de suas imperfeições, buscar também a correção destas mesmas imperfeições, além de haver a tentativa de recuperar esses jovens envolvidos com a criminalidade, evitando-se situações onde estes possam ser corrompidos, ao invés de serem recuperados e ressocializados.The ECA, when adopting the integral protection theory, which sees the child and adolescent as people in a developing phase, who need differentiated, specialized and integral protection, had no intention to maintain impunity to the youngsters, authors of penal infractions, for it created social-educational measures that, in fact, are real penalties, like those applied to adults. It is true that, when creating these social-educational measures, the legislator tried to present with a different form of treatment to young adults, reckoning in them their peculiar conditions of developing people. On this line of thought, the measures should be applied to recover and reintegrate the youngster to the community, which unfortunately doesn’t happen, for when the penalties are executed they are changed into real penalties, completely empty, inefficient, generating impunity, so criticized and combated by so many.
