Para entender a legalidade desse ato, o primeiro ponto analisado foi os alicerces da teoria do crime, seus conceitos formais, materiais e analíticos. Entender, posteriormente, o que é o estupro e as consequências, psíquicas, físicas e morais, causadas pelo agressor do crime fez-se importante para adentrar nas minúcias do art. 128, II do CPB e compreender o porquê de o legislador autorizar essa prática no Brasil. De maneira geral, o autor visa em seu trabalho à observância dos aspectos que garantem o aborto ético amparado pelo livre arbítrio da mulher, vítima do estupro, ou de seu representante.The author proposes an approach over the aspects that allow the realization of an abortion derived from a rape. In order to understand the lawfulness of this act, the first issue analyzed is the basis of the theory of crime and its formal, material and analytical concepts. Hence, it is necessary to understand what rape is and what are the psychic, physical and moral consequences caused by the crime aggressor in order to get into the details of the art. 128, II of CPC and comprehend why the legislator would authorize this practice in Brazil.
