Diante disso, nessas últimas décadas as sociedades têm recorrido às técnicas de Reprodução Humana Assistida, tendo surgido vários problemas de índole ético-legal. Nesta pesquisa se identifica a infertilidade como problema de saúde e se faz uma revisão dos principais procedimentos terapêuticos atuais, bem como dos problemas surgidos ante as limitações normativas dos dispositivos jurídicos vigentes e a ausência de legislação específica sobre o assunto. Em especial, neste trabalho, discute-se os limites éticos e jurídicos da RA em seres humanos. Considerando certo, entretanto, que a resposta ética necessária a elucidação de questão relativas à RA ainda não logrou a profundidade, a amplitude e a riqueza que o tema em estudo requer. No âmbito jurídico, visto sob o prisma da legislação positivada, a questão também não está definida a contento, embora não se negue os inúmeros avanços da matéria tratada no âmbito constitucional interno, e no âmbito de normas como as previstas na Lei de Biossegurança Nacional. Finalizando, coloca-se como objetivo precípuo para a realização dessa monografia determinar como a reflexão sobre os Direitos Humanos avigorará as ponderações éticas nas leis que irão reger a Reprodução Assistida no Brasil. Para consecução de tal objetivo seguiu-se a linha teórica de Almeida (2000); Araújo (2001); Berlinger (2004); Bobbio e Bovero (1986); Comparato (1999); Herkenhoff (1999): Ommati (2006); Piovesan (1998) e Trindade (2000), entre outros doutrinadores. Como conclusão mais importante, inferiu-se que o respeito aos Direitos Humanos acarretará a edição de legislação que regule a Reprodução Humana Assistida pautada na ética construída historicamente na sociedade brasileira.The infertility constitutes a problem that affects the couple; with the time, the conflict can become worse, getting to constitute reason for separation, keeping the psychological and social repercussions that a rupture of that nature carts. Before that, on those last decades the societies have appellee to the techniques of Attended Human Reproduction, having appeared several problems of ethical-legal nature. In this research he/she identifies the infertility as problem of health and it is made a revision of the main current therapeutic procedures, as well as of the problems appeared before the normative limitations of the effective juridical devices and the absence of specific legislation on the subject. Especially, in this work, it is discussed the ethical and juridical limits of the Reproduction Attended in human beings. Considering certain, however, that the necessary ethical answer the relative subject elucidation to the Reproduction Attended didn't still achieve the depth, the width and the wealth that the theme in study requests. In the juridical extent, seen under the prism of the positive legislation, the subject is not also defined satisfactorily, although he/she doesn't refuse the countless progresses of the matter treated in the internal constitutional extent, and in the extent of norms as foreseen them in the Law of Bio national security. Concluding, it is put as I aim at first for the accomplishment of that monograph to determine as the reflection on the Human Rights will increase the ethical considerations in the laws that will govern the Reproduction Attended in Brazil. For attainment of such an objective Almeida's theoretical line was proceeded (2000); Araújo (2001); Berlinger (2004); Bobbio and Bovero (1986); Comparato (1999); Herkenhoff (1999); Ommati (2006); Piovesan (1998) and Trindade (2000), among other theoretical ones.
