Diante das rupturas conjugais que decorrem de forma conflituosa, os filhos podem ser utilizados como arma de vingança, via de regra, pelo genitor detentor da guarda única, onde se inicia o fenômeno da alienação parental, em que o alienador utiliza-se de um conjunto de manobras, ao criar uma relação bem mais intensa com seu filho, assume o controle total da situação, promovendo a “lavagem cerebral” no menor, com o único objetivo de destruir o vínculo deste com o outro genitor. O presente trabalho traz o instituto da guarda compartilhada como prevenção e possível solução a alienação parental, assim como uma forma de atenuar os efeitos negativos decorrentes do rompimento da relação conjugal. Visto que, com a dissolução da sociedade conjugal e o fim do casamento extinguem-se direitos e deveres relativos aos cônjuges, contudo, jamais poderá colocar termo nas responsabilidades e na relação parental.Over the years, the family has undergone several transformations and family interactions and its structures have accompanied these changes. Another relevant factor among these changes is the large increase in divorce rate. Regarding conflictive marital disruptions, children can be used as a weapon of revenge, usually by the parent who owns the total custody, initiating the phenomenon called “parental alienation”, in which the alienator uses a set of maneuvers to create a much more intense relationship with his/her child, taking full control of the situation and promoting the "brainwashing" in the child, with the sole aim of destroying the relationship with the other parent.
