Destes surgiu também o princípio do consentimento informado, onde o médico deve esclarecer ao paciente todos os pontos relacionados ao seu diagnóstico, tratamento e prognóstico, incluindo os riscos e benefícios de aceitá-lo ou não. A partir deste ponto, o paciente está apto a exercer a sua autonomia e decidir se aceita ou recusa o tratamento prescrito. Na maior parte das vezes, não há conflitos nesta relação, porém, não é o que acontece com as Testemunhas de Jeová. Com base na sua interpretação dos textos bíblicos e evocando o direito à liberdade religiosa, tentam exercer a sua autonomia recusando tratamentos que incluam a transfusão sanguínea e/ou seus derivados. No entanto, não logram êxito. A Resolução nº 1.021/80 do CFM determina ao médico transfundir mesmo contra a vontade do paciente, alegando que o princípio da beneficência, neste caso, é mais importante. Frequentemente o Judiciário é chamado a intervir no conflito e exarar seu posicionamento com base na legislação. Na maior parte das vezes decidem no sentido de anular o direito à liberdade religiosa com vistas a uma suposta superioridade do direito à vida. Todavia, conforme Alexy, não há um direito fundamental superior ao outro, estes têm caráter prima facie, ou seja, devem ser aplicados no maior âmbito possível na medida em que se relacionam com os outros direitos. Assim como os princípios fundamentais possuem o mesmo peso, a decisão de qual deles deve prevalecer deve ser feita a partir dos parâmetros do princípio da proporcionalidade e da ponderação de interesses. Nesse diapasão, o presente trabalho aprofunda o conflito entre os princípios fundamentais, apresentando, de maneira prática, as soluções cabíveis a este caso concreto.The medical performance, according to the Code of Medical Ethics, must follow the bioethics principles of autonomy, beneficence and justice. From them, also emerged the principle of informed consent, where the doctor should explain to the patient all the points related to their diagnosis, treatment and prognosis, including the risks and benefits of accepting it or not. From this point, the patient is able to exercise their autonomy and deciding if agree or refuse the treatment offered. In most cases, there are not conflicts in this relationship, however, that is not what happened with the Jehovah's Witnesses. Based in their Bible‟s interpretation and evoking the freedom of religion‟s right, they try exercising their autonomy, refusing treatments that include blood transfusion and/or its derivates. However, they fail to successfully. The Resolution # 1.021/80, from Conselho Federal de Medicina, determines to the doctors transfuse, even against the patient‟s wishes, claiming the benefice‟s principal, in this case, is most important. Usually, the Judiciary has been called to intervene in the conflict and to define its position based in the law. Most of the time, they decide to annul the freedom of religion‟s right on account of a supposed superiority of the right to life. Nevertheless, according to Alexy, there is not a fundamental right above another, they have character prima facie, in other words, they must be applied in the largest possible scope to the extent that they relate to other rights. As the fundamental principles are the same weight, the decision on which one should prevail must be made from the parameters of the principle of proportionality and balance of interests.
