Ocorre que o Novo Diploma Civil estabeleceu que o valor por estimativa a ser considerado deverá ser aquele que o bem tinha à época da liberalidade. No entanto, ao ser aplicada esta regra, o bem doado terá valor distinto dos demais bens integrantes do acervo hereditário, que serão avaliados ao tempo da abertura da sucessão, o que poderá acarretar um desequilíbrio entre os quinhões hereditários dos herdeiros necessários (descendentes e cônjuge sobrevivente). Assim, para garantir o cumprimento do princípio da Igualdade da Legítima e alcançar o objetivo da Colação, o mais justo e adequado seria manter a regra trazida pelo parágrafo único do art. 1.014 do Código de Processo Civil de 1973, onde o bem, objeto de colação, terá seu valor calculado à época da abertura da sucessão.This research is about the hotchpot institute per estimation, according to Brazilian Civil Code of 2002, that recaptures an old discussion among Brazilian Jurists about the most fair value that would be applied to the hotchpotted goods, the donatio time or the succession’s opening. The New Civil Diploma had established that the values per estimation to be considered must be the one the property had by the time of the liberality. When this rule is applied, the donated property will get a distinct value of the others integral goods of the hereditary assets, that will be evaluated by the time of the succession’s opening, what could occur in a disequilibrium between the hereditary shares of the necessary heirs (descendents and living spouse).
