Para tanto, estabeleceu-se como objetivo geral a avaliação da legitimidade do Ministério Público na condução direta da investigação criminal e objetivos específicos a contextualização do Ministério Público, da Polícia Judiciária, o confronte de argumentos a favor e contra a investigação criminal realizada pelo Ministério Público e concluir se o Ministério Público e comprovar ou não a legitimidade do Ministério Público na investigação criminal. Como método utilizou-se o hipotético-dedutivo em que se indagou sobre os contornos do modelo constitucional e processual penal brasileiro sobre as funções conferidas ao Ministério Público e desse questionamento extrair a legitimidade, ou não para realizar a investigação criminal. A técnica aplicada foi a pesquisa bibliográfica, documental, doutrinária e jurisprudencial referentes ao Ministério Público e a Polícia Judiciária. O estudo conclui que o Ministério Público não está legitimado a realizar investigações criminais e age com excesso de poder quando investiga criminalmente; que pela pouca vivência democrática do Brasil as instituições não se encontram em harmonia e em sistema de cooperação, existe uma luta pelo poder entre as instituições para que somente uma delas seja o salvador da pátria. A solução encontrada é vivência democrática.The present work has as fear the criminal inquiry carried out by the Prosecution of the offenders. For so much, it established itself as general objective the evaluation of the legitimacy of the Prosecution of the offenders in the straight conduction of the criminal inquiry and specific objectives the contextualization of the Prosecution of the offenders, of the Judicial Police, confronts of arguments to favor and against the criminal inquiry carried out by the Prosecution of the offenders and conclude the Prosecution of the offenders and verify or not the legitimacy of the Prosecution of the offenders in the criminal inquiry. As approach utilized itself the hypothetical-deductive one in that itself inquired about the contours of the Brazilian penal procedural and constitutional model about the functions conferred to the Prosecution of the offenders and of that questioning extract the legitimacy, or not for carry out the criminal inquiry. To technical it applied was jurisprudential, doctrinary, documentary, and bibliographical research regarding the Prosecution of the offenders and the Judicial Police. The study concluded that the Prosecution of the offenders is not legitimized to carry out criminal inquiries and acts with excess of power when investigates criminally; that by the little democratic experience of Brazil the institutions are not found in harmony and in system of cooperation, exists a fights by the power between the institutions for that only one of them be the savior of the homeland.
