Monografia (Graduação) – Universidade Católica de Brasília, Brasília, 2009.https://repositorio.ucb.br:9443/jspui/handle/10869/4107DireitoDurante anos o Supremo Tribunal Federal sofreu com o crescimento do número de recursos extraordinários que aguardavam sua manifestação, o que dificultava o trabalho desta Corte. Por meio da Emenda Constitucional n. 45 de 2004, acrescentou-se ao art. 102 da Constituição Federal o § 3°, que trás a exigência de demonstração da repercussão geral no recurso extraordinário. Trata-se de um filtro recursal somado ao juízo de admissibilidade do recurso extraordinário, que permite ao Supremo Tribunal Federal realizar a apreciação apenas de causas que possuam relevância do ponto de vista jurídico, econômico, social e político, diminuindo assim o fluxo de processos enviados a esta Suprema Corte. A obediência a este instituto revela-se como condição de acesso a Suprema Corte, responsável pela uniformização do direito. A aplicação desse instituto traz conseqüências, por vezes inesperadas, em relação ao funcionamento deste Tribunal, visto que se refletem sobre a sociedade de modo geral e influenciam substancialmente as demais instâncias do Poder Judiciário.For years the High Federal Court has suffered with the growing numbers of extraordinary resources that waited for the manifestation, which made this Court´s jog harder. Through the Constitutional Amendment n 45/2004, it had been added to the art. 102 of the Federal Constitution the third §, which made mandatory the demonstration of general repercussion at the extraordinary resource. It is a resource filter added to the judgment of requirements of the extraordinary resource, which allows the Supreme Federal Court to treat only those cases of high importance from the juridical, economical, social, and politic point of view, lowering them the number of cases sent to this Court. The obedience to this institute is a condition to have access to the, responsible for the unification of the law.
