Inexistia naquela época uma legislação especial que os protegesse e, com isso, eles eram trados da mesma forma que os adultos. Foi no ano 1959, com a promulgação da Declaração Universal dos Direitos da Criança, que se deu o primeiro passo rumo a inovações no campo jurídico relacionado às Leis infanto-juvenis, pois com ela se reconhece que as crianças e adolescentes também deveram ser reconhecidos com sujeitos de direito. Posteriormente surgiram novas Leis, tal como o Código de Menores, porém nenhuma destas foi tão revolucionária como o Estatuto da Criança e do Adolescente, a qual regulamentou de forma mais ampla e completa a situação infanto-juvenil no Brasil, trazendo consigo o princípio da proteção integral, reconhecendo a criança e o adolescente como sujeitos de pleno direito. O Estatuto trouxe também direitos e garantias desses jovens, os princípios norteadores, as medidas protetivas (artigo 101) e as medidas sócio-educativas estabelecidas no artigo 112. As medidas sócio-educativas, ao contrário das protetivas, são aplicadas somente a adolescentes que cometeram uma infração. Dentre elas, encontra-se a internação, devendo ser aplicada em caráter excepcional e breve, por se tratar de uma medida privativa de liberdade. Infelizmente isso não é o que ocorre na maioria das vezes no Brasil e a internação acaba sendo usada para excluir ainda mais os jovens do convívio em sociedade, burlando o seu principal objetivo que é justamente o de reinserir o menor infrator na sociedade. se mostra com as melhores condições de êxito, porquanto se desenvolve direcionada a interferir na realidade familiar e social do adolescente.Since ancient times children and adolescents were treated as people who lived on the margins of society.
