Onde será analisada a questão da redução da maioridade penal, tema de grande clamor pela atual sociedade, tendo em vista o alto numero de atos infracionais cometidos. O Brasil sempre apresentou transformações acerca do tema. A principio a igreja era a ordem suprema e aplicando penas corporais e espirituais, nos dias de hoje a criança e o adolescente se encontram em uma situação de proteção integral, estabelecida pelo ECA, regulamentada no artigo 228 da Constituição Federal de 1988.Que adotou um sistema de medidas sócio-educativas, e neste sentido o legislador pensou em um sistema com aspectos parecidos ao que é aplicado aos adultos, porém de forma diferenciada, como forma de recuperar o menor infrator. Sendo o menor um individuo inimputável, a legislação cuida ao critério biopsicológico, considerando o um ser em formação, não tendo um desenvolvimento mental completo, tendo seus direitos garantidos pelo já referido ECA. É um assunto constitucional plenamente discutível uma vez, que se encontra em um campo diverso dos direitos e garantias fundamentais; pela grande divergência que o tema aborda e, por conseguinte pelos inúmeros problemas a serem analisados, assim como pelas diversas consequências que resultariam da decisão tomada.This paper is structured in four chapters. Where shall address the issue of reducing the age of criminal, matter of great outcry by the current society, in view of the high number of offenses committed. Brazil has always had transformations on the subject. At first the church was the supreme order and applying corporal punishment and spiritual, nowadays children and adolescents are in a situation of full protection established by ECA, regulated in Article 228 of the Federal Constitution adopted a system of 1988.Que of social and educational measures, and in this sense the legislature thought of a system with features similar to that applied to adults, but in a different way, as a way to recover the juvenile offender. Being the lowest untouchable an individual, the law takes care biopsychological criteria, considering a being in training, not having a complete mental development, having their rights guaranteed by ACE cited.
