Analisa a evolução da pena de prisão desde seu uso apenas como custódia até a função de sanção propriamente dita. Tem como objetivo demonstrar que a regeneração do indivíduo preso é possível quando o Estado e a sociedade trabalham em conjunto. O Estado, atualmente, não tem agido nas causas do problema, mas sim nos efeitos, aplicando punição ao mal cometido pelos criminosos, sem, contudo atingir o objetivo essencial da recuperação dos infratores e diminuição da criminalidade. Aborda também os problemas estruturais enfrentados atualmente, os desafios a serem ultrapassados para a efetiva aplicação da Lei de Execução Penal (Lei nº 7.210/1984) em todos os seus aspectos. Ressalta, por fim, a necessidade de oferecimento de trabalho a todos os condenados, como fator essencial para a reabilitação e a prevenção da reincidência, bem como para que os sentenciados sintam prazer em estudar e trabalhar, com reais possibilidades de reinserção na sociedade após o cumprimento da pena.This research is about the characteristics of Brazilian penitentiary system and the freedom privative penalties, as well as the prisoner criminal treatment and the rehabilitation measures . It analyzes the punishment evolution since its use as safekeeping until the function of sanction properly said. Its objective is to demonstrate that the imprisoned regeneration is possible when State and society work together. Currently, the State has not acted in the causes of the problem, but on its effects, applying punishment to crimes, without reaching the essential objective: the infractors recovery and crime reduction. It also tackles the structural problems faced currently, the challenges to be exceeded for the effective application of the Penalty Enforcement Law (nº 7.210/1984 Law) in all its aspects.
