Inicialmente, busca definir o que é a coisa julgada e o seu alcance no direito processual civil brasileiro. Para o deslinde da questão, é indispensável a análise do princípio da segurança jurídica e o reconhecimento do seu valor para o Estado Democrático de Direito. Ademais, é feita uma análise da importância dada aos princípios atualmente e a influência que estes tiveram na concepção atual do processo. Nesse sentido, demonstra a necessidade do aplicador do direito realizar a ponderação de valores, com base no princípio da proporcionalidade, para analisar em cada caso se será necessária a relativização da coisa julgada inconstitucional, posto que essa deverá ocorrer sempre em hipóteses excepcionais. Para compreender o surgimento da teoria da coisa julgada inconstitucional, o trabalho aborda a importância da observância do princípio da supremacia constitucional em face da Constituição Federal da República brasileira e as razões que fazem com que um ato judicial que ofenda à Constituição poderá ser desconstituído, em respeito ao valor maior que é o de justiça.This view work studying the phenomenon of relativization of res judicata unconstitutional. Initially, seeks to define what is res judicata and its scope in Brazilian civil procedural law. To disentangle the issue, it is essential to analyze the principle of legal certainty and the recognition of its value to the democratic rule of law. Moreover, an analysis is made of the importance given to the principles currently and the influence these have had on the current design process. In this sense, demonstrates the necessity of applying the law carry a weighting of values, based on the principle of proportionality, to examine in each case whether it is necessary to relativize the thing ruled unconstitutional, since this will always occur in exceptional circumstances.
