Dentre essas mudanças deve-se o reconhecimento de novos modelos familiares pela Constituição Federal de 1988, que reconhece a família monoparental e a união estável como instituições familiares. A presente monografia busca analisar outro aspecto da evolução da família, ligando dois temas de fundamental importância para nossa sociedade, que é a adoção e a união homoafetiva. Apesar da união homoafetiva já ser tema pacificado, a adoção conjunta por pares homoafetivos ainda não tem amparo legal expresso em nossa legislação. Por não se ter amparo legal o processo de adoção conjunta ainda é, infelizmente, moroso e lento. Esta lentidão ocasiona a permanência de crianças e adolescentes em instituições acolhedoras, quando poderiam estar desfrutando a companhia de uma família que poderia lhes proporcionar afeto, proteção e cuidados. Ao se deferir a adoção deve-se levar em conta o melhor interesse da criança e do adolescente, de maneira a despir de toda forma de preconceitos que possa prejudicar a proteção integral voltada para a criança e do adolescente.Throughout history, the institution of the family has undergone major changes in its structure. Among these changes is due to the recognition of new family models by the 1988 Federal Constitution, which recognizes the single-parent family and stable institutions like family. This monograph seeks to analyze another aspect of the evolution of the family, linking two issues of fundamental importance to our society, which is the adoption and marriage homoafetiva. Despite the union homoafetiva now be pacified theme, joint adoption by homosexual couples has no legal support expressed in our legislation. Because there is no legal support the process of joint adoption is still, unfortunately, time consuming and slow. This slowness causes the retention of children and adolescents in institutions cozy when they could be enjoying the company of a family that could give them affection, protection and care.
