Diante de sua aplicabilidade, o instrumento da penhora on line foi inserido na legislação brasileira pela Lei 11.382/2006, que acrescentou o art. 655-A no Código de Processo Civil. Com isso, muitas críticas surgiram, como por exemplo, o excesso de penhora, o excesso de execução e a quebra de sigilo bancário. A criação do Sistema BACEN JUD, no âmbito trabalhista, ocorreu por meio de convênio de cooperação técnico-institucional entre o Tribunal Superior do Trabalho (TST) e o Banco Central do Brasil (BACEN), consistindo no bloqueio de valores do executado em contas-correntes e aplicações financeiras, até o limite da execução, com intuito de amenizar a morosidade da satisfação do crédito exeqüendo. Fica evidente, conforme posicionamento jurisprudencial analisado, que as críticas feitas à penhora on line são infundadas, tendo em vista que o sistema é seguro e atende ao devido processo legal, pois seja não há supressão de nenhuma fase do processo de execução trabalhista. A sistemática trazida com a penhora on line trouxe agilidade e celeridade na prestação jurisdicional trabalhista.This work aims to demonstrate the importance, the benefits and effectiveness of the attachment online in the process of implementing labour. Before its applicability, the instrument of garnishment online was entered in the Brazilian legislation by Law 11,382/2006, which added the art. 655-The code of civil procedure. The BACEN JUD, under labour, occurred through a technical cooperation agreement between the Tribunal superior institutional work (TST) and the Central Bank of Brazil (BACEN), consisting in blocking values run on current accounts and financial applications, to the extent of implementation, adepts counter-Act the sluggishness of satisfaction from exeqüendo.
