Partiu-se do princípio de que a fiança é um contrato que estabelece uma obrigação acessória de garantia de cumprimento de uma outra obrigação (art. 818 do Código Civil). Tal dispositivo configurando-se como um instituto do ordenamento jurídico brasileiro que visa a proteção dos credores. Nessa perspectiva, o objetivo geral proposto consiste em apresentar uma análise teórica sobre as consequências jurídicas da fiança nos contratos de locação, sob a ótica do Direito e da jurisprudência. A questão norteadora a ser investigada está relacionada à controvérsia sobre a responsabilidade do fiador tanto no âmbito dos contratos por prazo determinado quanto naqueles onde a prorrogação do contrato acontece de forma natural. Ressalte-se que tal polêmica é freqüente tanto no meio doutrinário quanto na jurisprudência, fato este que justifica a relevância em abordar tal tema. Estruturada em três capítulos, inicialmente a pesquisa discorre sobre a evolução do contrato, seus conceitos, modalidades e funções. A seguir, é feita uma abordagem sobre o contrato de locação e o contrato acessório de fiança e suas consequências jurídicas. Ao final, será feita uma análise sobre as consequências jurídicas da fiança no contrato de locação, discorrendo sobre a posição da doutrina e da jurisprudência relativa à questão ora levantada.This is literature of exploratory theme with deductive and the legal consequences of bail on the lease. It started from the assumption that the bond is a contract establishing an accessory obligation of ensuring compliance with any other obligation (art. 818 Civil Code). Such a device configured as an institute of the Brazilian legal system that seeks protection from creditors. From this perspective, the proposed overall goal is to present a theoretical analysis of the legal consequences of the guarantee in lease agreements from the perspective of law and jurisprudence. The main question to be investigated is related to the controversy over the liability of the guarantor of both under fixed term contracts as those where the contract extension happens naturally. It should be noted that this controversy is common among both doctrinal and case law, a fact that justifies the importance of addressing this issue. Structured in three chapters, the research initially discusses the evolution of the contract, its concepts, procedures and functions. The following is an approach made on the lease and ancillary contract of guarantee and its legal consequences.
