Trabalho de Conclusão de Curso (Graduação) - Universidade Católica de Brasília, Brasília, 2008.https://repositorio.ucb.br:9443/jspui/handle/10869/3567DireitoO tema a ser desenvolvido visa demonstrar a realidade atual da internação como medida sócio-educativa prevista no Estatuto da Criança e do Adolescente para o menor que pratica ato infracional e sua eficácia, ou seja, se a mesma proporciona a reinserção social deste adolescente ou se é uma forma de punição. Assim faz-se necessário o estudo sobre a evolução dos direitos da criança e do adolescente, bem como da medida sócioeducativa, e aborda também aspectos relacionados à sua aplicabilidade. Busca definir o que é criança e adolescente, suas diferenças, bem como distinguir as medidas que cada um está sujeito, quando da prática de ato infracional. Será feita uma análise sobre o que é o adolescente no contexto de condição peculiar de pessoa em desenvolvimento. Trata das medidas sócio-educativas, primeiramente sob o seu aspecto geral e posteriormente, realiza uma análise da medida sócio-educativa de internação em seus aspectos punitivo, repressivo e educativo para que se possa aferir se estão sendo eficientes para ressocializar o adolescente infrator, ou se estão lhes oferecendo chances reiteradas de persistir na criminalidade e por último aborda sobre a necessidade de existir uma lei de Execução de Medidas Sócio-educativas, rompendo com a desregulamentação da área e opondo-se definitivamente ao arbítrio. Verifica-se que a estrutura atual dos estabelecimentos de atendimentos ao adolescente, precisa de melhorias para alcançar o objetivo da execução da medida sócioeducativa de internação, a qual seja a ressocialização do adolescente em conflito com a lei.The theme the developed being aims demonstrate the current reality of the internment as foreseen measure partner-educational in the child's Statute and of the Teenager for the minor who practices I tie infraction and its effectiveness, in other words, whether the same provides for reinserçtion social of this teenager or is a punishment form. It will be made an analysis about what is the teenager in the person peculiar condition context in development. Care for the measures partner-educational, firstly under your general aspect and afterwards , accomplishes an internment measure partner-educational analysis in her punitive, repressive and educational aspects so that it can check they are being efficient for ressocialization the teenager offender, or we are offering them chances reiterated of persisting in the criminality and finally boards about the need to there be an Execution law of Measured Partner-educational, breaking with for unregulation of the area and opposing itself definitively to the will.
