Trata, principalmente, do conflito de leis como ponto sensível do assunto na busca das melhores soluções a serem aplicadas às necessidades do adotado. A regulamentação da adoção internacional no Estatuto da Criança e do Adolescente foi um grande avanço para o ordenamento jurídico brasileiro. A Convenção de Haia de 1993, ratificada pelo Brasil, regulou requisitos e condições para que a adoção internacional fosse efetivada. A referida Convenção trouxe, ainda, medidas de segurança à relação adotiva internacional, para que fatos ligados ao tráfico internacional de menores não aconteçam. O estudo do direito comparado da adoção internacional é fundamental para se traçar um paralelo com o que é vivenciado no Brasil acerca da matéria. A adoção de brasileiros por estrangeiros ainda é vista com discriminação por grande parte da sociedade brasileira e constitui medida excepcional, somente sendo aceitável quando as possibilidades de inserção de uma criança em uma família substituta nacional forem esgotadas. Porém, este é um assunto que não é pacífico e divide opiniões de especialistas. O conhecimento que a sociedade tem acerca do instituto da adoção internacional é mínimo, o que vai a desencontro ao grande número de crianças sem família existentes nos orfanatos brasileiros, ou fora deles, à espera de uma nova chance de serem felizes em seus futuros lares.This work analyzes the institute of the international adoption under the parameters legal and social. It treats, mainly, of the conflict of laws as sensible point of the subject in the search of the best solutions to be applied to the necessities of the adopted one. The regulation of the international adoption in the Statute of the Child and the Adolescent was a great advance for the Brazilian legal system. The Convention of Haia of 1993, ratified for Brazil, regulated requirements and conditions so that the international adoption was accomplished. The related Convention brought, still, measures of security to international the adoptive relation, so that on facts to the international traffic of minors do not happen. The study of the comparative jurisprudence of the international adoption it is basic to trace a parallel with what it is lived deeply in Brazil concerning the substance. The adoption of Brazilians for foreigners still is seen with discrimination for great part of the Brazilian society and constitutes measured bonanza, only being acceptable when the possibilities of insertion of a child in a national substitute family will be depleted. However, this is a subject that is not pacific and divides opinions of specialists.
