Para melhor análise do tema, inicia-se uma análise geral dos direitos humanos, examinando seus conceitos, princípios e aspectos históricos, no Brasil e no mundo. Por conseguinte, o foco é voltado para a proteção internacional dos direitos humanos, abordando o direito internacional, os principais tratados internacionais pertinentes ao tema central do estudo monográfico e o conflito entre normas nacionais e internacionais. Posteriormente, o objeto é a violação aos direitos humanos, apreciada por meio da responsabilidade internacional do Estado e das Cortes Internacionais, trazendo também exemplos de órgão responsáveis pela garantia dos direito humanos, quais sejam, a Corte Internacional de proteção aos Direitos Humanos e Tribunal Penal Internacional. Em seguida, são analisados os argumentos favoráveis ao uso do incidente de deslocamento de competência no Brasil, abrangendo as vantagens da aplicação do instituto e os benefícios que o mesmo pode assegurar ao país no cenário internacional. Ainda no mesmo capítulo, a aplicação do incidente de deslocamento de competência é exposta à luz do princípio da proporcionalidade. Ao final, há uma breve apresentação do caso Dorothy Stang, objeto do primeiro incidente de deslocamento de competência, e a posterior decisão do Superior Tribunal de Justiça. Por fim, uma síntese do segundo caso de Incidente de Deslocamento de Competência - extermínio em Pernambuco e Paraíba -, em que o Superior Tribunal de Justiça deferiu o referido deslocamento de competência. Conclui-se através dos argumentos apresentados, bem como dos julgados do Superior Tribunal de Justiça que o instituto da federalização dos crimes contra os Direitos Humanos, não viola qualquer dispositivo constitucional, confirmando que a medida não representa afronta à ordem jurídica.This monograph is focused on the federalization of crimes against human rights analyzed with relevant issues involving the transfer of jurisdiction of state courts to federal courts in cases of serious human rights violations from the assessment of its antecedents. To better analyze the issue, begins with an overview of human rights, examining its concepts, principles and history aspects in Brazil and worldwide. Therefore, the focus is toward the international protection of human rights, addressing the international law, international treaties relevant to the main theme of this study and the conflict between national and international standards. Subsequently, the object is the violation of human rights combined with by international responsibility of state and international courts, and bringing examples of the agency responsibility for safeguarding human rights, namely, the International Court of Protection of Human Rights and Criminal Court International. Next, we analyze the arguments in favor of using the incident to transfer of jurisdiction in Brazil, covering the advantages of applying the institute and the benefits it can assure the world stage. Still in the same chapter, the application of the incident displacement of competence is exposed to the principle of proportionality. Finally, there is a brief case presentation Dorothy Stang, be the first incident of transfer of jurisdiction, and the subsequent decision of the Superior Court. Finally, a synthesis of the second case of incident Offset Jurisdiction - extermination in Pernambuco and Paraiba - where the Supreme Court granted such transfer of jurisdiction.
