A importância do tema se comprova ante a divergência jurisprudencial existente entre o TST e o TRT da 10ª Região, sobretudo no que tange à ilegalidade e inconstitucionalidade da decisão da Suprema Corte Trabalhista brasileira, a qual contraria, também, o entendimento do STF. O primeiro capítulo do trabalho trata do instituto da prescrição, focando na importância que exerce sobre a segurança jurídica das relações. O segundo capítulo aborda os principais tópicos do infortúnio laboral, os efeitos que gera na relação de trabalho e a atuação do INSS na concessão dos benefícios previdenciários. O terceiro capítulo, por sua vez, traz a possibilidade da reparação do dano sofrido em virtude do acidente do trabalho, explanando as diversas teorias que embasam a proteção ao trabalhador acidentado, bem como os requisitos necessários para a configuração da responsabilidade do empregador. Por fim, o quarto capítulo aborda a problemática da incidência da prescrição, seja na doutrina ou na jurisprudência, focando nas conseqüências que a falta de um entendimento pacificado causa à sociedade.This work monographic search examine the incidence of prescription in stock compensation resulting from the accident at work, it is seen that existed in the legal system averages rule expressed on the subject. The importance of the subject is confirmed before a judicial disagreement between the TST and the TRT 10th Region, particularly in respect to unlawful and unconstitutional the decision of the Supreme Court Brazilian Labor, which contradicts also the understanding of the STF. The first chapter deals with the work of the institute's prescription, focusing on the importance it carries on the legal security relations. The second chapter addresses the main topics of misfortune labor, the effects that generates the relationship of work and the performance of the INSS in the granting of pension benefits. The third chapter, in turn, brings the possibility of repairing the damage as a result of the accident at work, explaining the various theories that supports the protection to the worker rough, and the requirements for setting the responsibility of the employer.
