Resumo: | Throughout the history of Brazilian educational legislation, child education has been legitimized as a formal education space and contemplated in the legal instruments as a child’s right. In this article we will contemplate the construction of the notion of the right to school education, trying to understand how historically man began to refer to the concept of human rights and how it impacted on the concept of the right to school education and right to early childhood educationin Brazil. This bibliographic review served as a basis for the development of the master’s research entitled “Quality in children’s education in a school in the city of Fortaleza: a look at the construction of a concept”. |

Neste artigo iremos contemplar a construção da noção de direito à educação escolar, buscando entender como historicamente o homem começou a se remeter ao conceito de direito do homem e como este impactou no conceito de direito à educação escolar e direito à educação infantil no Brasil.
