Opacity of a Brazilian agrarian legislation

Resumo: This article deals with the ignorance of the scope of the normative toolsdue to lack of understanding of the Law or its access thatcharacterizes the law opacity. The opacity of the law is due to the excess of norms (Laws, Decrees, Ordinances and so on.) as one can find in the agrarian legislation of Minas Gerais Brazilian State. This State, in the 1940s, turned his interest focus to the development and exploitation of the mineral resources of the Middle Rio Doce at geographic east center of the State. As a way of raising funds of this endeavour, the sale of vacant lands was at stake. This economic policy was the first step forsome farmers to constitute the property of large piece of land via annexation of plots of former inhabitants. This was possible thanks to the complex and confusing legislation that was at the ground of the administrative process of land appropriation and also known as opacity of the law.

A opacidade do direito pode dar-se devido ao excesso de normas (Leis, Decretos, Portarias etc.) num determinado regime o que é observado, por exemplo, na legislação agrária mineira. Estado de Minas Gerais, na década de 1940, voltou seu interesse para o desenvolvimento e exploração dos recursos minerais do Médio Rio Doce e a forma de levantar recursos, para tais empreendimentos, foi a venda de terras devolutas, o que contribuiu para que alguns fazendeiros constituíssem grandes fazendas anexando glebas de moradores habituais.
