Resumo: This article reflects on the analysis of the affirmative politics of the State in combating conjugal violence, in particular the Maria da Penha Law, in light of Habermas’s theory of democracy. We ponder the effectiveness of its measures in addressing the gender issues raised by the feminist movement of the 970s, appropriated by the State as a political program and expropriated of the communicative rationality of the individuals who are members of civil society.
