Assigning risks and criminalizing poor and non-white: determining risk factors in 24 actuarial tools for the US criminal justice system

Resumo: | In the USA, from the 1920s actuarial tools are used in the evaluation of parole applications, to predict or estimate the possible recurrence of applicants. Since then, they have been used to better manage the population under correctional control by calculating the risk of recidivism or failure to appear, based on factors such as criminal history, age, marital status, sex, and behavior, based on criminological theories and machine learning techniques. These tools are based on the forms application and the choice of their questions influences the definition of risk factors. Currently, there are more than 400 tools in use in the distinct stages of the US Criminal Justice System, across state, national and county jurisdictions, after increasing criticism of bail system and the biases of criminal justice operators. This article analyzes forms from 24 tools used by U.S. jurisdictions. The main results are that the tools have focused on a specific type of suspect – poor and black people – since their conception, even though companies and government agencies argue that they are neutral and objective. |

Desde entonces, se han utilizado para gestionar mejor la población bajo control penitenciario, calculando el riesgo de reincidencia o no comparecencia ante el tribunal, en base a factores como antecedentes penales, edad, estado civil, sexo y comportamiento, con base en teorías criminológicas y técnicas de aprendizaje automático. Estas herramientas se basan en la aplicación de formularios y la elección de sus preguntas influye en la definición de los factores de riesgo. Actualmente, hay más de 400 herramientas en uso en las diferentes fases del sistema de justicia penal de los EE. UU., En las jurisdicciones estatales, nacionales y del condado, particularmente después de las crecientes críticas al sistema de fianzas y los prejuicios de los operadores de justicia penal. Este artículo analiza cuestionarios de 24 herramientas utilizadas por jurisdicciones estadounidenses. Los principales resultados son que las herramientas se han centrado en un tipo específico de sospechoso, pobres y negros, desde sus inicios, a pesar de que las empresas y las agencias gubernamentales argumentan que son neutrales y objetivos.Nos EUA, a partir da década de 1920, ferramentas atuariais passaram a ser usadas na avaliação dos pedidos de liberdade condicional, a fim de prever ou estimar a possível reincidência dos requerentes. Desde então, têm sido utilizadas para melhor administrar a população sob controle correcional, calculando o risco de reincidência ou de não comparecimento à Justiça, a partir de fatores como antecedentes criminais, idade, estado civil, sexo e comportamento, com base em teorias criminológicas e técnicas de machine learning. Essas ferramentas são baseadas na aplicação de formulários e a escolha de suas questões influencia a definição dos fatores de risco. Atualmente, existem mais de 400 ferramentas em uso nas diferentes fases do sistema de justiça criminal dos EUA, entre jurisdições estaduais, nacional e de condados, principalmente após o aumento das críticas ao sistema de fiança e aos vieses dos operadores da justiça criminal. Este artigo analisa questionários de 24 ferramentas utilizadas por jurisdições dos EUA.
