Resumo: Faced with substantialist and proceduralist theses and its various points of friction as the interpretation, proposes this work that the prospect of solution fits the perfect foundation linking the judge to the case and at this point, the new civil procedure code apparently brought to light one appropriate formula to be applied by the Brazilian Constitutional Court.
