The study proposed in this paper aims, from the existing philosophical relationship with the law,  demonstrates  the  moral  dimension  of  procedural  institutes  brought  with  the  new provisions of Law nº 13.105/2015 (New Code of Civil Procedure). The ethical and moral character in the new procedural provisions in Brazil, has a democratic foundation and aims to overcome the quite remarkable Proceduralism in Buzaid Code, initiating a new paradigm (New  Democratic  Formalism):  dynamic  contradictory  principleprimacy  of  merit  trial, enlargement of the appeal fungibility, effective grouding of decisions ... The theoretical framework  of  the  paper  consisting  of  hermeneutics  philosophy  and  philosophical hermeneutics (Heidegger/Gadamer), the Political Justice (Höffe), in the Law as Integrity (Dworkin) and HermeneuticalCritical of the Law (Streck) in a (required) approach between law and philosophy to the substantive and constitutionally adequate adjudication.
