ELECTRONIC NOTARY DEEDS - E-NOTARIAT:: EXPANSION OF ACCESS TO JUSTICE WITH THE ADVENT OF COVID-19 – AN ANALYSIS OF PROVISION 100 OF CNJ

Resumo: With the advent of Covid-19 in Brazil, there was aneed to confine the population. As a result, several sectors wereaffected, including the judiciary. New means of dispute resolutionwere sought, including extrajudicial means and the use of newtechnologies. Thus, Provision No. 100/2020 of the NationalCouncil of Justice (CNJ) emerged, which provided for thepractice of electronic notarial acts by notary offices. This studyverifies the following questions: did the “E-notariat” platform,implemented from Provision n° 100, reach the desired levels toexpand the right of access to justice? Was there continuity, inthe post-pandemic period, in the use of this tool? The objectiveis to analyze the effectiveness of the “E-notariat”, as a way ofexpanding access to Justice. This research is justified by virtueof the constant need to expand resources for access to justiceand to promote non-judicialization. For that, we resorted tobibliographical research – based on the authors Cappelletti,Garth, Watanabe and others; and documentary research – throughthe “Notary in Numbers” reports. The research method washypothetical-deductive. Indeed, it was seen that the “E-Notarial”platform was successful, bringing speed and practicality tocitizens, thus allowing the expansion of access to justice.

Com isso, diversossetores foram afetados, inclusive o Judiciário. Buscou-se novosmeios de solução de controvérsias, incluindo as vias extrajudiciaise o uso de novas tecnologias. Surgiu, assim, o Provimento n°100/2020 do Conselho Nacional de Justiça (CNJ), que dispôssobre a prática de atos notariais eletrônicos pelos tabelionatosde notas. Este estudo verifica as seguintes questões: a plataformado “E-notariado”, implementada a partir do Provimento n° 100,alcançou os patamares desejados para ampliar o direito de acessoà justiça? Houve continuidade, no período pós pandêmico, do usodesta ferramenta? Tem-se como objetivo analisar a efetividadedo “E-notariado”, como forma de ampliação do acesso à Justiça.A pesquisa se justifica em virtude da necessidade constante deampliar os recursos para o acesso à justiça e de promover adesjudicialização. Para tanto, recorreu-se à pesquisa bibliográfica– pautada nos autores Cappelletti, Garth, Watanabe entre outros;e à pesquisa documental – por meio dos relatórios “Cartórioem Números”.
