Resumo: Due process of law is an institute that promotes the controversy in the legal intricacies, especially when it comes to their practical meaning. The initial focus of this paper is to outline the essential properties of substantive due process to subsequently determine the basis of the proportionality principle as an essential denominator for achieving procedural validity. Suitability, necessity and excess ban: the decomposable facets of proportionality are presented. From these elements seek to give greater social dynamic to the application of proportionality as essential practical function for proper maintenance material due process

São apresentadas as facetas decomponíveis da proporcionalidade: adequação, necessidade e proibição do excesso.
