Resumo: | Direct contracting, due to the lack of a bidding process, of technical services for legal and legal advice is possible, provided that the requirements of arts. 25, II c / c 13, V, of Law no 8.666 / 93 (BRASIL, 1993) and art, 74, of Law No. 14.133/21 (BRASIL, 2021). However, the issue raises academic discussions and also in the Judiciary, as the indiscriminate use of this exceptionality for the performance of activities that do not present unusual complexities can give rise to the imputation of contractors in an act of administrative improbity, because the contracting does not havethe uniqueness required by the Bidding Law. For the developmentof the article, a methodology based on bibliographic research andthe analytical procedure was used, developing from the critical approach of the consulted works and documents, in order to obtain a reasoned analysis on the subject under study. It is concluded that the direct hiring of a lawyer or law firm by a public entity, by means of unenforceable bidding, in itself, does not constitute an unlawful act. |

Contudo, o tema suscita discussões acadêmicas e também no Judiciário, na medida em que a utilização indiscriminada dessa excepcionalidade para o desempenho de atividades que não apresentam complexidades incomuns pode ensejar a imputação dos contratantes em ato de improbidade administrativa, porque a contratação não se reveste da singularidade exigida pela Lei de Licitações. Para o desenvolvimento do artigo, empregada metodologia centralizada na pesquisa bibliográfica e no procedimento analítico, desenvolvendo-se a partir da abordagem crítica das obras e documentos consultados, a fim de se obter uma análise fundamentada acerca do tema em estudo.
