Resumo: | This research examines which type of civil liability applies to the application provider Google Ads in situations of damage arising from content generated by its advertisers in its sponsored links service. The characteristics of the Internet, the damages and the possibility of regulation of the virtual space were analyzed, taking into account the technique of the site, civil liability in its concept and function, along with its objective and subjective types, focusing on the type provided in Article 19 of Law No. 12,965/14 -Civil Framework of the Internet. This article of law takes into consideration the technical and legal aspects of the Internet, not applying objective liability, both for risk and for the legislator's will, to application providers, which must preside over freedom of information and the prohibition of censorship. The result is the understanding that Google Ads has subjective liability for damages that the content of the advertisers' links may cause, which occurs when the provider fails to comply with a court order to remove the content and/or other obligations imposed by the Judiciary, after being duly notified, and remains inert. Bibliographic review and jurisprudential research were applied by using deductive reasoning. |

Bibliographic review and jurisprudential research were applied by using deductive reasoning.A pesquisa objetiva compreender qual o tipo de responsabilidade civil aplica-se ao provedor de aplicação Google Ads em situação de danos decorrentes de conteúdo gerado pelos seus anunciantes em seu serviço de links patrocinados. Analisou-se as características da internet, os danos e possibilidade de regulação do espaço virtual, levando-se em conta a técnica do local, a responsabilidade civil em seu conceito e função, juntamente com seus tipos objetivo e subjetivo, focando no tipo previsto no artigo 19 da Lei n° 12.965/14 -Marco civil da Internet. Referido artigo de lei leva em consideração os aspectos técnicos e legais da internet, não aplicando a responsabilidade objetiva, tanto pelo risco quanto pela vontade do legislador, aos provedores de aplicação, que devem presar pela liberdade de informação e vedação à censura. O resultado é a compreensão de que o Google Ads possui responsabilidade subjetiva por danos que o conteúdo dos links dos anunciantes venha a causar, configurando-se quando o provedor se omite em cumprir com a ordem judicial de retirada do conteúdo e/ou outras obrigações impostas pelo Judiciário, após devidamente notificado, mantendo-se inerte.
