Resumo: It is discussed about chapter 1 of the work entitled “The political-legal command of theConstitution”, by João Luiz Martins Esteves. The author aims to identify if there is a political-legalcommand in each Constitution, seeks to identify an ideological character in legal theories, from thestate model in which it belongs. It exposes the types and conceptions of state existing in history,from the first manifestations that identified the Constitution as a political model, to the inclusionof individual, political and social rights, with an insertion of the Constitution in the center of legalorder. It points out that it combines with this pragmatic change, mechanisms have been built toguarantee the judicial protection of rights extracted from the Constitution.

O autor com o propósito de identificar se existe um comando político-jurídico em cada Constituição, busca identificar um caráter ideológico nas teorias jurídicas, a partir do modelo de Estado em que pertença. Expõe os tipos e concepções de Estado existentes na história, desde as primeiras manifestações que identificaram a Constituição como um modelo político, até a inclusão de direitos individuais, políticos e sociais, com a inserção da Constituição no centro do ordenamento jurídico.
