Resumo: | This paper focuses on the tension between the role of the Federal Supreme Court as a negative legislator in cases of diffuse constitutionality control and the limits of jurisdiction in the use of constitutional change. With bibliographic review and analysis of decisions of Brazil’s Supreme Court, this paper reached two fundamental conclusions that concern, first, a new format for controlling diffuse constitutionality, and second, the judicial activism resulting from the extrapolation of the limits of the constitutional jurisdiction with the technique of constitutional change. |
