Compliance and data protection in the information society: biopower or biopolitics

Resumo: We live in the information society, due to the amount of data produced, and in the consumer society, due to the economic influences on subjectivities. It is necessary to protect information to safeguard subjective rights. The General Data Protection Law appears, applied to the corporate scope, and the compliance program is a legal-social instrument that, depending on the attitude of senior management, can translate into a centralizing biopower. Using the deductive methodology, we seek to present, through the integrity program, a way to build an inclusive and plural organizational culture, based on the commitment and example of the high command, in a positive representation of current biopolitics.

É necessária a proteção das informações para salvaguarda dos direitos subjetivos. Surge a Lei Geral de Proteção de Dados, aplicada ao âmbito corporativo, e o programa de compliance é instrumento jurídico-social que, a depender da postura da alta administração, pode traduzir-se num biopoder centralizador.
