Resumo: The current research has emerged from a reflection process on the perspective of the philosophy of law, which extends to the horizons of biopolitics and biopower. The forms of violence that fall on man as a form of domination and appropriation, reducing him to the species of naked life, are objects of analysis in this study. We observe that the crisis in Law is not apart from this reality; coversely, the crisis is the result of this process. In general, this thesis analyzes whether the legal phenomenon can be identified as a legal phenomenon within itself or a political-legal phenomenon. Finally, our proposal resumed the assumptions of the Habermasian communicative reason linked to the idea of popular sovereignty, as the guiding line for a redemocratization of law, established between the facticity and the validity of the Law.

Las formas de violencia que sobrevienen al hombre como forma de dominación y apropiación, reduciéndolo a una especie de vida desnuda, constituyen objetos de análisis en este estudio. Observamos que la crisis del Derecho no es ajena a esta realidad, al contrario, la crisis es consecuencia de este proceso. A nivel general, esta tesis analiza si el fenómeno jurídico puede identificarse como un fenómeno jurídico en sí mismo o como un fenómeno político-jurídico. Finalmente, nuestra propuesta retomó los presupuestos de la razón comunicativa habermasiana vinculada a la idea de la soberanía popular como línea directriz para una redemocratización del derecho, establecida entre la facticidad y la validez del derecho.A pesquisa ora desenvolvida surgiu a partir de um processo de reflexão tomada sob a perspectiva da filosofia do direito, e que adentra nos horizontes da biopolítica e do biopoder. As formas de violência que recaem sobre o homem como forma de dominação e apropriação, reduzindo-o à espécie de vida nua, constituem objetos de análises deste estudo. Observamos que a crise do Direito não está alheia a essa realidade, pelo contrário, a crise é resultante deste processo. Em um plano geral, esta tese analisa se o fenômeno jurídico pode ser identificado como um fenômeno jurídico em si ou um fenômeno político-jurídico.
