Resumo: This article aims to understand the reasons that lead families to withdraw their children from school in order to adopt alternative forms of education, as well as to examine socio-legal arguments about homeschooling involved in the families’ right to choose alternative forms of education for their children. It is intended to explore the issues that permeate the subject, making it possible to deepen the theoretical and legal discussions. There are authors who defend the families’ right of choice, and others who warn against the risk of children not receiving formal education. Three families were interviewed, who carry out homeschooling for religious and health reasons. It is concluded that the manifestation of the Judiciary and the Legislative is necessary for this confusion to be solved, since families defend the possibility of choosing the education given to their children, while the State advocates compulsory schooling. Religion.Este artículo tiene como objetivo comprender los motivos que llevan a las familias a retirar a sus hijos de la escuela para darles otras formas de educación, así como examinar argumentos socio-jurídicos sobre la educación domiciliaria involucrados en el derecho de elección en la formación de sus hijos. Se pretende conocer los problemas que afectan el tema, lo que permite profundizar las discusiones teóricas y jurídicas. Hay autores que defienden el derecho de elección de las familias, y hay otros que advierten sobre el riesgo de que los niños no reciban formación educacional. Fueron entrevistadas tres familias que realizan enseñanza en el hogar por razones religiosas y por motivos de salud. Se concluye que es necesaria la manifestación del Poder Judicial y del Legislativo para que este embrollo sea resuelto, ya que las familias defienden la posibilidad de elección de la educación que reciben sus hijos, mientras que el Estado defiende la escolarización obligatoria. Religión.Este artigo visa compreender os motivos que levam famílias a retirar seus filhos da escola para dar-lhes outras formas de educação, bem como examinar argumentos sociojurídicos a respeito do ensino domiciliar que permeiam o direito de escolha na formação de seus filhos. Pretende-se conhecer as questões que permeiam o tema, tornando possível o aprofundamento das discussões teóricas e jurídicas. Há autores  que defendem o direito de escolha das famílias, e há outros que alertam para o risco de crianças não receberem uma formação educacional. Foram entrevistadas três famílias, que realizam ensino domiciliar por razões religiosas e por motivos de saúde. Conclui-se que é necessária a manifestação do Judiciário e do Legislativo para que tal imbróglio seja sanado, uma vez que as famílias defendem a possibilidade de escolha da educação conferida a seus filhos, enquanto o Estado defende a compulsoriedade escolar.
