Resumo: This article deals with the interpretation and application of article 406 of the Civil Code (“CC”). As will be seen, the rate of the Special System for Settlement and Custody ("Selic Rate") has been adopted as a reference by the Superior Court of Justice for the calculation of default interest and monetary correction under the terms of the aforementioned article of the CC. In this sense, we will seek to understand the historical perspective that revolves around this debate, the reasons why such an understanding has been established - which, we advance, is correct in view of our legal system - and its application in the scope of law current civil law.
