PROVISIONAL GUARANTEES AND THE EFFECTIVENESS OF THE DECISIONMAKING PROCESS SUPPORTED BY BRAZILIAN LEGISLATION

Resumo: The law 13.146/2015 brought innovations and advances related to the protection of the disabled people, especially introducing the procedure of supported decision making (Tomada de Decisão Apoiada – TDA). The innovation, however, was not accompained by a processual instrument suitable to the promptness demanded by this kind of situation. Thus, this article aims to investigate the possibility of application of the discipline related to the provisory injunctions to the supported decision making procedure. Based on bibliographic analysis and in comparative law, this research circumscribes a deductive method in weighting the possibilities of ensuring the rights of disabled people through provisory injunctions.

Tal inovação, todavia, não veio acompanhada de um aparato processual hábil a sua efetivação de forma célere e efetiva frente às necessidades dos assistidos. Assim, o presente artigo pretende investigar a possibilidade de extensão da disciplina aplicável às tutelas provisórias ao procedimento da TDA.
