Palavras-chave Fundamentação – metodologia jurídica – requisitos da decisão judicial Abstract This article analyzes the connection between the studies of judicial methodology and the duty to motivate, as prescribed by the Brazilian Constitution. It is proposed that methodological studies, such as those conducted by Perelman or Alexy, may contribute to establish the content of the duty to give judicial reasons. Such a contribution is generally esteemed by the specialized doctrine. Nonetheless, the Brazilian Supreme Court is strict only when it reviews the reasoning of lower courts' decisions that restrict human rights. Even though it is sensible to privilege such decisions, it may be too much not to care about the judicial reasoning of more ordinary judgements.
